When creating an account on WaitlistWizard, you agree to provide accurate and complete information. 5. Subscriptions and Payments

Some features of WaitlistWizard are paid: paid subscription plans, and one-time per-watch charges on the free plan. Payments are processed by Stripe. Subscription fees are billed monthly in advance and are non-refundable except where required by law. You can upgrade, downgrade, or cancel your subscription at any time through the billing portal; changes apply from the moment Stripe confirms them.

We do not guarantee that a watch will find a table. Watch fees pay for the monitoring service itself — checking availability and alerting you — not for a reservation.

6. Use of the Service

You agree to use our services only for lawful purposes and in a manner that does not violate the rights of others. Prohibited actions include, but are not limited to:

• Using our service to engage in illegal activities or to distribute harmful, obscene, or offensive content.
• Harassing or intimidating other users or impersonating another person.
• Attempting to interfere with the functionality of our website or service, such as by introducing viruses or other harmful code.

7. User-Generated Content

You may submit content such as comments, reviews, or other materials through our website. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, distribute, and display your content. You are solely responsible for the content you submit, and we reserve the right to remove content that violates these Terms or applicable law.

We are not responsible for the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that WaitlistWizard shall not be liable for any damages resulting from your use of third-party websites or services.

10. Termination of Service

We reserve the right to suspend or terminate your access to our website or services at any time, without notice, if we determine that you have violated these Terms or engaged in any conduct that may harm our users, services, or reputation.

11. Disclaimers and Limitation of Liability

Our service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, secure, or free from errors.

In no event shall WaitlistWizard be liable for any indirect, incidental, or consequential damages arising from your use or inability to use our services, even if we have been advised of the possibility of such damages.

These Terms are governed by and construed in accordance with the laws of Colorado, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Colorado, and you consent to the jurisdiction of those courts.

13. Dispute Resolution

Any disputes arising out of or related to these Terms shall be resolved through binding arbitration in Denver, Colorado, in accordance with the rules of the American Arbitration Association. Both parties waive the right to bring any disputes to court, except to enforce an arbitration award.

14. Indemnification

You agree to indemnify and hold harmless WaitlistWizard and its affiliates, officers, agents, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any rights of a third party.
